Thank you for visiting the Toledo Zoo Online Store. This online store is operated by the Toledo Zoological Society (“Toledo Zoo”) and our store adheres to the following terms:

1. Acceptance of Terms: By supporting the Toledo Zoo and placing an order on this website, you agree to these Terms and Conditions which govern all purchases. You may not order products from this website if you (A) do not agree to these terms, (B) are not older than eighteen (18) years of age, or (C) you are otherwise prohibited from using this website by law.
2. Order Acceptance and Cancellation: You agree that your order is an offer to buy the product(s) requested in your order, subject to these terms and conditions. All orders must be accepted by the Toledo Zoo and we may choose not to accept orders subject to our sole discretion. Acceptance of your offer will not take place until we have received payment and you have received a confirmation email.
3. Price and Payment: All listed prices are subject to change without notice. Price increases will only apply to orders placed after such changes. Posted prices do not include taxes or shipping and handling, both of which are to be added during the checkout process. Payment must be received by us before your order is accepted.
4. Title and Risk of Loss: Title of the product and risk of loss are transferred to the customer upon the transfer of the product from the Toledo Zoo to the carrier/delivery partner.
5. Shipping: You, as the customer, will pay all shipping and handling charges specified during the ordering process. Shipping and delivery dates are estimates only and cannot be guaranteed. The Toledo Zoo is not liable for any delays in shipments.
6. Returns and Refunds: Satisfied customers are our mission! If you are not satisfied with your purchase, you may return any unopened merchandise within thirty (30) days of the purchase and receive a refund of the purchase price, less shipping and handling costs. Returns must be made within thirty (30) days of shipment with valid proof of purchase. For more information see our Returns Policy.
7. Warranties: The Toledo Zoo does not manufacture or control any of the products sold in our online store. As a result, we do not provide any warranties with respect to the products sold on our site. Products may be covered by a manufacturer’s warranty that is separate and unrelated to the Toledo Zoo.

9. Intellectual Property: An item purchased from this website may be subject to copyright, trademark, or patent protections. You are to comply with the relevant restrictions on the purchased product. This provision includes, but is not limited to, intellectual property of the Toledo Zoo.
10. Limitation of Liability: Our liability will not exceed the actual amount paid by you for the defective product you have purchased. We will not be liable to you or any third party for consequential, incidental, special, exemplary, or punitive damages in connection with this transaction.
11. Entire Agreement: These Terms and Conditions incorporate by reference any notices on the Toledo Zoo website and, together with the Privacy Policy and other applicable policies, constitute the entire agreement for use of the Toledo Zoo’s online shop and all other related websites.
12. Applicable Law: These Terms and Conditions shall be governed and interpreted in accordance with the laws of the State of Ohio, without regard to principles of conflicts of laws. Any dispute arising out of this agreement is to be brought in Federal or State court located in Lucas County, Ohio, and the parties hereby waive any objection that they may have to personal jurisdiction in these courts.
13. Severability: If any provision of this agreement is found to be unenforceable, that provision is deemed severed from these Terms and Conditions and will not affect the validity of the remainder of this Agreement.
